1. Your are on a website owned and constructed by Ultima Model Engineering Ltd.
2. Our registered office is: 52 Wellesley Street, Tredworth, Gloucester, GL1 4QP.
3. All references to us we refer to this name and address.
4. You must be 18 years of age to use this site or have the permission of a parent and be supervised.
5. Any orders you make on this site constitute a contract to purchase with Ultima Model Engineering Ltd. and forms a legally binding agreement to purchase, This does not affect your statutory rights.
6. Communication with us may be by email, phone or by letter.
7. A contract will exist upon acceptance by us of your order and confirmation by us usually by email and or phone. We may at any time contact you by phone to confirm the order as a random check for your security.
8. You must agree to our terms and conditions to submit orders.
9. You agree that the information you give about the order are accurate and we cannot accept liability for mistakes not of our making.
10. You should print a copy of the confirmation of the order if by email and check it for accuracy.
11. You will undertake to indemnify us from any misuse of goods ordered by you used for any purpose to which they were not designed or for any purpose that is illegal or immoral in any way.
12. If there are any details supplied by you that change and it affects the order in any way you will notify us of any changes.
13. We undertake that no details provided by you to us either about items ordered or personal information will be disclosed to any other body either as an enquiry or purchase for commercial gain except as is neccessary to clear your payment, communicate with you and deliver your goods. Personal data may also be disclosed to the authorities in investigation of criminal activity. This does not affect your rights under the data protection act.
14. All credit card or debit card details are only collected by Protx who act as the financial collection agents owned and part of the banking process. Protx do not pass on details to us and they are held securely on databases not accessible to the public or any other individuals or organisations not authorised to have access to this data.

16. We use where possible 3D security to process all card transactions. You may be required to sign up for 3D security. This is similar to Verified by VISA and Master card Securecard. This is an online security system designed by the banks to combat fraud and theft in online transactions where pin numbers cannot be used. It is a combination of the previously mentioned security system. You must at all times adhere where possible to their requirements or we will not be held accountable for any loss thereof. You may be able to pay without signing up to this system if prompted but it is for your protection and it will be considered a breach of contract if you deliberately avoid signing up and a problem occurs directly or indirectly because of this.
17. You may at any time cancel an order as laid down in distance selling regulations provided you adhere to our rules on cancellation.
18. Cancellations may be made at any time if you do not want the goods any more provided you return the goods unopened and in new unused condition. Any packaging removed or damaged in any way will constitute a breach of these conditions and we may consider the goods as damaged or used unless informed of damage in transit from us to you by our carrier.
19. Notice of damage from our premises to you must be made within 24 hours by phone and confirmed in writing either by email or letter within 48 hours or if impossible at least within 72 hours.
20. Any goods returned under such conditions will not have the postage refunded by us, You will have to bear the cost of postage. We may refund monies paid to your card as soon as we can and in any case within 28 days but retain the right to subtract the bank charge or carriage charge if sent or ordered for the original transaction.
21. Any goods returned that are not in original condition may have a charge to reflect the condition they are received in. you must ensure the goods are securely packed and boxed in such a way that they will not be damaged by carriage. Goods damaged in transit will be investigated and if liability proved against the carrier you will not be liable for such damage.
22. We reserve the right to make a restocking charge for any goods returned as unwanted if received in used or damaged condition and it is reasonably deemed that the said goods have been opened in any way.
23. Goods ordered as a special order either as an item we usually do not stock or as stock that is normally specially ordered as being slow stock or as a special service to meet a deadline will not normally be accepted back unless you agree to pay a reasonable charge (normally 25% plus the charges by carrier and the banks) for us to hold stock we would not normally expect to stock unless this stock is ordered from overseas in which case we will not take said goods back under any circumstances. This does not affect your statutory rights.
24. In the unlikely event you receive goods from us which were not ordered or are damaged or defective or not as described or are of different quantities or quality to what you would be reasonably be expected to receive, We will at our discretion make good any shortages not delivered and make no additional postal charge unless we tell you that all your order is not all available and offer you the option of having what we have in stock and the rest to follow as and when it is available by the manufacturer. Or repair or replace in that order any goods that are damaged or defective and in the last refund to you any monies if all else fails. Provided you inform Ultima Model Engineering Ltd. within 24 hours as previously stated in clause 19. Nothing in this or any other clause affects your statutory rights.
25. Goods provided by us are for your private and personal domestic use. We will not be held liable for any loss either directly or indirectly for loss of data, consequential loss, loss of income or profit or such claims by third parties arising from such loss, in addition we will not accept liability for the same such losses by misuse of our website or purchases of products from us or of any services provided by Ultima Model Engineering Ltd.
26. All electrical goods are covered by a 3 month guarantee at the minimum by the manufacturers against faults. Any claims under guarantee must be notified to us as stated in clause 19 and goods either sent directly to us at your cost unless required by us under legislation. We will then usually tell you to return the goods to us but under certain circumstances we may require you to send the goods to the manufacturer directly.. This is usually because it is more convenient for you and you will get the goods back more quickly. This does not affect your statutory rights.
27. You may not permit or act in any way to cause unauthorised framing or deep linking to any other website or the creation of derivative works thereof.
28. This site content is copyright and as such we retain or own the rights to any images contained therein unless credits show otherwise. You may not copy or mail such images to others without the express permission of our web manager and the company. We will retain and own absolutely the intellectual property rights contained therein whether registered or unregistered.
29. The Company may at any time vary these terms and condition and we will post notice of such on our website homepage. We will not accept liability for any errors contained either in these conditions or for prices or descriptions on the website. Any orders taken where it has clearly seen to have been priced wrongly will be reported to you and you will have the right to cancel or accept the new price or change of description. Any charges for carriage are contained within our postal charges page and you should refer to that page for such charge rates.
30. As a precaution against criminal activity we will retain tracking identifiers of all orders made and will pass all information to the police in such cases, In any case where we may have cause to believe that any prospective purchaser is abusing our terms and conditions or abusing our purchasing system and has a track record of continually returning goods for spurious reasons will be banned from our site.
31. It is a crime to use a false name or invalid credit or debit card. We will further prosecute to the fullest extent of the law any individual found using credit or debit cards for fraud either by providing false names or addresses or making any sort of fictitious order for such.
32. These terms and conditions are subject to the laws and exclusive jurisdiction of the United Kingdom.
